[NEWS] 101027 SM Entertainment Withdraws Their Preliminary Injunction Against JYJ

SM Entertainment’s preliminary injunction against JYJ (Kim Jaejoong, Kim Junsu and Park Yoochun) to prohibit the sales of their first global album, The Beginning, has been withdrawn.
On October 27th, JYJ’s PR Agency Prain said, “On October 21st, through the Seoul Central District Court, SM Entertainment withdrew their preliminary injunction to prohibit the sales of JYJ’s first album, The Beginning.”
SM Entertainment filed the injunction on October 12th believing that JYJ had signed an exclusive contract with CJeS Entertainment which would cause a dual contract situation.
However, CJeS is the agency that JYJ hired to handle their management work just like Prain has been hired to handle JYJ’s PR.

[NEWS] 101013 SM Entertainment Files Injunction Against Sale of JYJ’s "The Beginning" Album

With JYJ’s Jaejoong, Yuchun, and Junsu preparing to release their first official album, “The Beginning,” a law firm representative has just revealed that SM Entertainment filed an injunction against the trio, prohibiting the sale of the album.
The sale of JYJ’s first album is now left entirely in the hands of the court. However, since it will take a considerable amount of time before a decision is made, it’s highly likely that the album will be released onto the market first.
The reason behind SM Entertainment’s restraining order is said to be found in the problems still remaining in their contracts. It has already been over a year since the three filed a lawsuit against SME and began walking a separate path on their own.
“The Beginning” is to be distributed by Warner Music Korea. Stay tuned for updates on this breaking story.

[News] SM Entertainment reports loss of 4 billion won from karaoke business

It has been reported that SM Entertainment (SME) has lost a monstrous sum of 4 billion won (approx. US $3.7 million) in the last 4 years, which coincides with the company’s expansion into the karaoke business.
In 2006, SM Bravo, a company that specialised in karaoke machines, was incorporated as a subsidiary by SM Entertainment in order for SME to expand their operations into the karaoke industry. Additionally, SM Amusement, a different company affiliated with the karaoke industry, was added to the list of subsidiaries when SM Entertainment incorporated it in 2008.
At the time of this expansion, SM Entertainment had announced that they would revolutionize the karaoke industry with their expertise in the Korean and Asian music market, as well as their influential network-ability in Asia.
However, after four years into this expansion, there remains only two karaoke establishments that are operating somewhat effectively. Additionally, the value and worth of the subsidiary company’s are failing to increase despite continued investments.
To summarise the total loss made my SM Entertainment:
SM Bravo has invested a total of 6 billion won, but by end of August 2010 it was reported that only 3.4 billion won was what remained of the account, resulting to a loss of 2.4 billion won.
SM Amusement has invested a total of 1.4 billion won, but as per bi-annual report, the investment has gone down the drain with the total resulting to impaired/eroded capital.
As a result of the loss, SM Bravo will be undergoing a merge with SM Amusement, with an SME representative stating, “A remodelling of the karaoke business was necessary and hence we are in the process of merging the subsidiaries together. Once they have merged we will come up with a brand new business plan.”
Meanwhile, netizens have voiced their opinions, “Don’t they know what happens when you start carrying too many eggs in one basket?”, “So that’s where all the hard earned cash from their artists go to”, “What a waste of sweat and tears from SNSD, Suju, Shinee, F(x)”, and my personal favourite comment – “This is a classic example of a parent running down their business and making their kids earn the money for them. And when the kids hand over their hard earned cash the parents then spend it on useless things instead of paying off their debt. Once the kids start telling them to stop the nonsense, the parents then tell them not to bite off the hand that feeds them when it’s obvious that the kids are feeding themselves with their own hands.”

[TRANS] 100819 'Yunho and Changmin will not disappoint'
SMTown artists including Kangta, Boa, Yunho, Changmin, Super Junior, Girl's Generation, SHINee, F(x) and Trax etc. will be taking part in a SMTown live concert in Seoul Olympic Stadium on the 21st.
The official name of the event is 'SMTown Live '10 World Tour in Seoul', and it is estimated that there will be a total of 80 songs performed over the course of 6 hours.
This is not the first time SM artists have gathered for a concert, this has been the case for many years and it is a way of displaying the strong bonds and friendships amongst SMTown. Of course, it also offers the audience a high degree of satisfaction.
The focal interest of this event is that it will comprise more artists than ever before, and since it takes the form a world tour, they will also be performing in China, Japan and the US etc. Representatives of SM said that 'This will be very different from the concert we had two years ago, this is a much larger scale world tour. The world tour will kick off in Seoul, and in order to reach out to overseas fans, we've been planning performances abroad for a long time. We will be holding a concert in LA on September 4th and travel to Shanghai and Tokyo etc. later on.
In preparation for the SMTown concerts, special stages featuring Yunho and Changmin were prepared. There will also be collaborations by Boa & Key, Kyuhyun & Seohyun, as well as Jessica & Krystal.
In particular, fans are highly anticipating special performances by Yunho and Changmin. Yunho delivered a mature and sophisticated live performance on March 27th this year at the Michael Jackson memorial concert, exhibiting his phenomenal skill and talent. Thinking back to that event makes fans wonder what he will have in stall for us this time. With regard to this, SM Entertainment confidently expressed that 'Details about Yunho and Changmin's stage will be kept confidential, but we assure you that you will not be disappointed.'
Moreover, SM pointed out that 'SHINee's Key has been a fan of BoA since before his debut so he is really looking forward to performing with her.' 'The collaboration between group maknaes Kyuhyun and Seohyun have also gained much interest and we are sure their beautiful voices will provide a refreshing feeling for the audience'
SM representatives claim that 'We hope to make this concert an enjoyable event where all members of the SM family are able to come together. Each artist has prepared his/her own numbers, some are songs from the past whilst others are collaborative dance stages.

[TRANS] JaeChunSu: The Truths & the Lies
Most of this is old news so I've only translated a summary of the article.
1. What is the point of this article?
Ever since the three members filed the lawsuit, the internet has been flooded with unconfirmed reports and false claims, and such rumors have spread to fans in foreign countries including China and Japan etc. The point of this article is to clear up some of the rumors about the three members so that they will not be wrongly accused.
2. Did the three members demand 10 billion won each from SM?
The trio's lawyer Lim Sang Hyuk stated that '”We have asked that SM Entertainment pay each member one billion Won first. The amount we file for compensation will increase but ten billion Won, which is the amount reported in some news articles, is a false report. We have not yet decided upon a final compensation amount.”
Whilst the trio have not filed lawsuit seeking a compensation of this amount, reports of them demanding 10 billion won from SM have spread quickly throughout the Korean media and such erroneous reports have yet to be corrected. This is a typical SM strategy: 'adding a zero after the initial figure' to mislead the audience, the same tactic was employed in the case with Crebeau, where members of the public were misguided and manipulated.
According to SM's contracts, if an artist were to violate the contract, then they would have to pay a sum of 400 billion won.
3. Did the letters 'CJ' appear in 'Heaven's Postman'?
Funds for the production for 'Heaven's Postman' came from the Korean Film Council, the financial industry as well as the distributing company itself.
There are 2 possible explanations for 'CJ' appearing in the movie:
1. During the filming of 'Heaven's Postman', Youngwoong Jaejoong was still under SM Entertainment. The production company accepted funds from CGV (a company under CJ which is also responsible for the production of Changmin's TV series)
2. 'Heaven's Postman' is distributed by CJ
4. Is the trio's new manager involved in triad activities?
Kim Yong Ho wrote two articles in total; the first claims the trio's manager to be a triad member whilst the second clarifies that he is not. Unfortunately, whilst the first article has spread to countries outside of Korea and Japan, the second has not gained much public attention.
Such harsh accusations not only lack reliability, they can also be considered slander against the three members.
5. Is there a big-name company funding the production of JaeChunSu's worldwide album?
The production and distribution of the trio's album will be managed by a company in the US, but the album itself is targeted at audiences throughout Asia.
6. What is the intent of spreading these false reports?
SM is manipulating the three members' status as artists to impair their image and make the three of them lose value.
By stirring up conflict and prolonging the lawsuit, SM hopes to minimize the company's losses.
7. What should we do as fans?
Whilst SM has persisted in misleading the public by spreading lies and rumors, the three members have yet to do anything to defame SM. When faced with large corporations such as SM, as powerless individuals, there is nothing we can do other than to accept the company's manipulation through the media.
Fans of all people, should understand that 'If there weren't an unfair contract, then there wouldn't be a lawsuit'
As fans, we must distant ourselves from these fictitious reports and rumors and calmly await the decision of the court. In the mean time, please continue to look over and protect the trio.

At the same time, people have expressed that if this issue is not solved as soon as possible, it would effect the hallyu wave. Lawyer Park Chan Chong noted: “Many people abroad understands that TVXQ is a cultural heritage from our country that should be cultivated and protected. And since the lawsuit between TVXQ and SM Entertainment arose, TVXQ could not continue activities normally, which brought great losses for the country.” He is very anxious. Also, lawyer Park Chan Chong expressed his views regarding this matter: “based on the contract terms between TVXQ and SM Entertainment, terminating the contract is impossible. However, it does contain the unfair slave contract, and this contract was signed when TVXQ were 19 and underage, so according to law, they can sue SM Entertainment for using underage teens for “illegal benefits” (349) as well as fraud fraud (348).
July of 2009, TVXQ had filed a contract suspension injunction against SM Entertainment, and at the same time SM side filed a lawsuit demanding the trio pay 2.2 billion won for compensation. Then, June 28th, 1010, the trio asked for 1 billion each, or 3 billion total won for compensation from SM.
For the best conclusion of this case, lawyer Park provided three solutions.
1) End the current working status where the trio and duo doing separate activities, let the 5 members return to working together as before.
2) The main reason for the conflict is because of SM, SM needs to solve the problem and give in.
3) Whether the contract is fair or not should be determined by the courts.
At the end he expressed, all the fans abroad loving and cherishing TVXQ hope to see the five members on one stage soon. Hope SM Entertainment will not forget or overlook this hope and anticipation.

[News] Daewoo Says SM Possesses At Least 50 Billion Won In Cash.. The Lawsuit Is Not A Problem
Daewoo Securities Co. Ltd. stated on the 29th that although SM’s stocks (041510) (12,950 Won, -3.00%) are plummeting due to the TVXQ lawsuit issue, the dip is nothing to greatly worry about.
Kim Chang Won of Daewoo Securities Co. Ltd. Research Center stated, “The current situation is a good opportunity to buy,” and “SM has at least 50 billion Won in cash reserves, so they will be able to easily cover a 3 billion Won compensation lawsuit.”
“Their second quarter sales will exceed the ballpark figure,” and “In the third quarter, SHINee and BoA’s domestic activities, Girls Generation’s Japanese activities and Super Junior M’s Chinese activities will reap great rewards.”

[TRANS] 100617 “SM Didn’t Defame Cosmetic Company & Yoochun/Jaejoong/Junsu”
The defamation and obstruction of work charges made by cosmetic company We# Plus against SM Entertainment’s Kim Young Min (40) have been dismissed.
According to JipyungJisung, the legal representatives of SM Entertainment, the prosecution dismissed the charges made by We# Plus against Kim Young Min as unnecessary to institute public action on the 31st. TVXQ’s Micky Yoochun (24), YoungWoong Jaejoong (24) and Xiah Junsu (23) have invested in this company.
Last year, SM stated that the legal dispute over TVXQ’s exclusive contract was “Not a happening that occurred due to an unlawful slave contract that violated human rights,” but rater “A lawsuit based off of monetary temptation which began with the cosmetic company.”
In retaliation, We# Plus sued Kim Young Min in two phases in August and November, stating that, “Although the three members have filed the injunction due to an unlawful contract, SM keeps pointing our company out as the cause of the situation,” and “They were trying to distort the facts and hide the real reason for this lawsuit, and our reputation was ruined in the process.”
JipyungJisung stated, “It looks like it was decided that the three members and their families are deeply tied to the business of this company as they violated TVXQ’s portrait rights to promote it.” They added that, “The prosecution has viewed the cosmetic company as one of the main reasons why this exclusive contract legal dispute began.”

The three members from TVXQ filed an exclusive contract suspension injunction on July 31st, 2009 against SM Entertainment because they “Wanted to escape from the shackles of an unfair contract”. U-Know Yunho (24) and Choikang Changmin (24) did not join in. The Seoul District Courts partially accepted the injunction on October 27th of last year. This meant that the Courts admitted that the contract between SM and the members of TVXQ was an unlawful one. However, they drew the line when it came to income division as it was decided that the topic would be discussed in the actual lawsuit.
