[TRANS] Xiah Junsu’s contract for ‘Tears of Heaven’ musical revealed

A confirmation photo of Xiah Junsu’s musical contract for ‘Tears of Heaven‘ has been revealed in order to clarify speculations on his performance wage for the musical.

According to the contract, Xiah Junsu was contracted to receive $7,000 USD for each of his 10-20 performances.

Xiah Junsu expressed,
“Vague rumors regarding the performance fees are ungrounded. I feel it is just a great honor for me to work alongside world-renown maestro Frank Wildhorn and other respected stars. I like how the music has both classic and pop elements.
“These days, the musical market is greatly diminishing, and I have great interest in original Korean musicals with global aims. Even though a lot of Korean movies and music have already advanced into the global market, there aren’t a lot of cases for Korean musicals. I felt that ‘Tears of Heaven’ was such a great musical that it could succeed internationally, which is why I decided to help in its investments.”

Not only is ‘Jekyll & Hyde‘ director Frank Wildhorn a part of the production staff, but the director of ‘Sweeney Todd‘, Gabriel Barre, has signed on as well. Worldwide famous musical star Brad Little will also be acting alongside Korean actors for ‘Tears of Heaven’>

[News] 100906 Jaejoong, Yoochun, and Junsu contract with Prain PR



TVXQ’s Jaejoong, Yoochun, and Junsu have recently signed a contract with a Korean PR consulting firm, Prain, officially beginning their individual promotions.

On the 6th, TVXQ’s three members revealed, “We’ve always reported news to the press through a law firm but decided to go with a PR business for a more systematic and specialized expression of our thoughts. Through Prain, we will be opening a variety of channels that allow for conversing with the press and industry representatives along with our fans.”


Prain’s main area of business revolved around government organizations, some of their clients being former presidents, soccer player Park Jisung, figure star Kim Yuna and others, managing their images and communications.

Although the concept is largely known in other countries, this is the first time a celebrity in Korea has separately contracted with both an agency and a PR agent. Prain representatives stated, “We are not TVXQ’s agency. We are their spokesperson and our responsibilities include managing their images and supporting their marketing and promotions.”

In order to promote the three members of TVXQ, Prain has set up an entertainment business team within the company. The team leader, Kim Sangwoo, stated, “We’re planning to create a transparent partnership as the spokesperson for the stars. We hope to enhance their image and quality as their PR agents.”

On the other hand, the three members are set to release a new album by the end of this year, produced by famous composer Kim Hyungseok and distributed by Warner Music Korea.

[TRANS] JaeChunSu: The Truths & the Lies

Most of this is old news so I've only translated a summary of the article.

1. What is the point of this article?
Ever since the three members filed the lawsuit, the internet has been flooded with unconfirmed reports and false claims, and such rumors have spread to fans in foreign countries including China and Japan etc. The point of this article is to clear up some of the rumors about the three members so that they will not be wrongly accused.

2. Did the three members demand 10 billion won each from SM?
The trio's lawyer Lim Sang Hyuk stated that '”We have asked that SM Entertainment pay each member one billion Won first. The amount we file for compensation will increase but ten billion Won, which is the amount reported in some news articles, is a false report. We have not yet decided upon a final compensation amount.”

Whilst the trio have not filed lawsuit seeking a compensation of this amount, reports of them demanding 10 billion won from SM have spread quickly throughout the Korean media and such erroneous reports have yet to be corrected. This is a typical SM strategy: 'adding a zero after the initial figure' to mislead the audience, the same tactic was employed in the case with Crebeau, where members of the public were misguided and manipulated.

According to SM's contracts, if an artist were to violate the contract, then they would have to pay a sum of 400 billion won.

3. Did the letters 'CJ' appear in 'Heaven's Postman'?
Funds for the production for 'Heaven's Postman' came from the Korean Film Council, the financial industry as well as the distributing company itself.

There are 2 possible explanations for 'CJ' appearing in the movie:
1. During the filming of 'Heaven's Postman', Youngwoong Jaejoong was still under SM Entertainment. The production company accepted funds from CGV (a company under CJ which is also responsible for the production of Changmin's TV series)
2. 'Heaven's Postman' is distributed by CJ

4. Is the trio's new manager involved in triad activities?
Kim Yong Ho wrote two articles in total; the first claims the trio's manager to be a triad member whilst the second clarifies that he is not. Unfortunately, whilst the first article has spread to countries outside of Korea and Japan, the second has not gained much public attention.

Such harsh accusations not only lack reliability, they can also be considered slander against the three members.

5. Is there a big-name company funding the production of JaeChunSu's worldwide album?
The production and distribution of the trio's album will be managed by a company in the US, but the album itself is targeted at audiences throughout Asia.

6. What is the intent of spreading these false reports?
SM is manipulating the three members' status as artists to impair their image and make the three of them lose value.

By stirring up conflict and prolonging the lawsuit, SM hopes to minimize the company's losses.

7. What should we do as fans?
Whilst SM has persisted in misleading the public by spreading lies and rumors, the three members have yet to do anything to defame SM. When faced with large corporations such as SM, as powerless individuals, there is nothing we can do other than to accept the company's manipulation through the media.

Fans of all people, should understand that 'If there weren't an unfair contract, then there wouldn't be a lawsuit'

As fans, we must distant ourselves from these fictitious reports and rumors and calmly await the decision of the court. In the mean time, please continue to look over and protect the trio.

Three members of 'TVXQ' have filed a lawsuit against SM Entertainment following their exclusive contract injunction.

According to the Seoul District Courts, Xiah Junsu (Kim Junsu), Micky Yoochun (Park Yoochun) and YoungWoong Jaejoong (Kim Jaejoong) filed an exclusive contract validity suspension lawsuit on the 25th.


Sejong, the law firm in charge of the trio's legal actions, stated, "The exclusive contract period is thirteen years from the date they debuted, however, if military service is taken into consideration, the length of the contract is in fact fifteen years," and "This violates Clause 103 of the civil code." Clause 103 of the civil code states that any legal acts that violate good customs or public order will become invalid. Sejong also stated, "If the contract is canceled, the members must pay an extravagant compensation fee that is three times the amount of total investments and twice the amount of what the group would have earned in the remaining period of the contract."


The trio submitted an exclusive contract suspension injunction last July which was partially granted in October. SM Entertainment also filed an objection to the partial acceptance verdict and a lawsuit to confirm the continued validity of the exclusive contract in April.

[TRANS] 100416 China Court: "TVXQ Has Nothing To Do With The Cosmetics Company Promotion"

SM Entertainment had attributed the main reason for the "TVXQ's Lawsuit" to be the cosmetics investment business by some of the TVXQ's members and used this reason as justification to propose a 2.2 billion won in damages from the 3 members.

The declaration that SM Entertainment had submitted to Seoul Central District Court on 14th April claimed that "Some TVXQ members had invested in a cosmetic company which resulted to be the beginning of the conflict. They have used TVXQ's name and portrait without the company's consent and that have violated the exclusive contract. However, they denied the effectiveness of the exclusive contract and proposed the disposition for the effectiveness of the termination of the exclusive contract". During November last year, China Beijing Kowloon Station Century Culture Communication Co. Ltd* (Gao Jian Wen, Representative. Also known as Beijing Kowloon Station Inc.) had used "The fraud of Crebeau which is the collaboration between TVXQ's 3 members and Korea Cosmetics Company, Wisyaplus had caused their damages" as the reason to apply for legal action for the damages compensation at the District Court. Recently, the cosmetics company, Wisyaplus announced that "Beijing Haidian District People's Court rejected the Beijing Kowloon Station Inc's claims" and revealed the China Court's arbitration decision documents.

According to the open verdict, the court had rejected all the arbitration applications from the applicant (Beijing Kowloon Station Inc.) and the applicant will bear all the costs for the arbitration (38,470 yuan = 5,635 USD). TVXQ's 3 members has nothing to do with the cosmetics company promotion and this was ultimately confirmed by the China Court. And SM Entertainment have been using the photos of the 3 members attending the investment seminars to suspect if the 3 members had directly or indirectly carry out promotional activities.

On the other hand, the cosmetic company's representative, President Kang Suk-won had expressed towards the accusation of SM Entertainment attributing the main cause of the TVXQ's lawsuit with the members' cosmetics business that "The police investigation has already shown that the reason behind the TVXQ's lawsuit has nothing to do with the cosmetics. However, SM Entertainment once again entangled with it. Therefore, our company will propose a reputation damage lawsuit again for the third time".

President Kang Suk-won claimed that "The reasons why TVXQ's 3 members had filed a lawsuit towards SM Entertainment are because of the unfair contractual relationship and unjust distribution of income distribution. This fact has been ruling in the injunction application and it was confirmed. However, such behaviour seems to have become a kind of inertia for SM Entertainment in order to rescue its company reputation".

Wisyaplus had already filed the reputation damage and impede business lawsuit towards SM Entertainment twice in August and November last year. Seoul Gangnam Police Department investigation ended in February and make the decision of without detention and transfer investigation towards SM Entertainment representative, Kim Youngmin. At that point of time, the police had already made a judgement that "The lawsuit of ending the long term exclusive contracts requested by TVXQ's 3 members had nothing to do with the cosmetics investment".

SM Entertainment is pulling and pulling more companies thinking that those supposedly scandals are the reasons behind the lawsuit when in fact it has no relation. Now, that more of their lies are being unearthed, many and many more troubles are coming to SM. This is why I advise you SMe... stop LYING!

[NEWS] SM Entertainment officially investigated for unfair contract terms!

Korea’s Fair Trade Commission (KFTC) has announced that they are currently investigating all celebrities bound to SM Entertainment regarding unfair contract terms, suggesting that “a second TVXQ scandal” like event may occur.

According to One Nation’s Jo Moon Hwan, it was revealed that KFTC is investigating cases of unfair contract terms in SME idols such as TVXQ (including Junsu, Yoochun and Jaejoong who are currently in legal disputes with their management company), SNSD, Super Junior, etc. for a total of 53 SME celebrities.

Jo Moon Hwan stated that the question and answer document received from KFTC specified investigations for all SME affiliated individuals for reasons related to a delay in taking care of TVXQ’s legal case. KFTC expressed,

“Through this event all celebrities in SME will undergo investigations to see if their contract terms go against the law of established fair contract terms, which is why TVXQ’s legal dispute is being delayed.”

Additionally, the commission said regarding TVXQ’s case, “All related documents will be carefully reviewed and considered for an appropriate outcome,” not revealing at what point the case would be over.

As you readers know, SM Entertainment has recently experienced many difficult trials as three members in TVXQ and Super Junior’s Hankyung underwent legal battles for problematic contract terms such as its 13 year length and unfair distribution of album sale profits.

Signing unfair contract terms with its employees is not only SME’s problem. Last December, KFTC requested 407 large agencies to address unfair contract conditions and undergo investigations. However, one month after this request was issued (until January) only 11 agencies reported their conditions and decided to take prompt corrective action measures, giving a huge shock to KFTC.

From April to May, YG Entertainment and Star Entertainment were also investigated along with 20 other companies. The results? 19 companies with 230 celebrities were found with contracts made up of various unfair conditions. These conditions were not about appearance limits but rather about the celebrity’s individual affairs such as telling agencies their current location and not being able to leave.

This investigation will concentrate on protecting weak celebrities who are powerless to request their affiliated large agencies for protection rights that they deserve.

AVEX official gave an official stand related to the chaotic/confusion among TVXQ fans both in Korea and Japan which has been happening after the article about TVXQ already stepped on disbanding procedure was released by Japanese newspapers.

On the 3rd, Nikkan Sports Japan quoted Japanese official from AVEX company, “The policy of TVXQ to work as five members doesn’t yet to change.”

However, as been informed, TVXQ contract with their Japan company AVEX will expire in June. If the contract is not extended from now on, whether TVXQ can continue activities in Japan, it won’t be yet secured.

Currently TVXQ Changmin and Yunho still remain under SM Entertainment while the rest members Jaejoong, Yoochun, and Junsu have left expanding their each individual activities.

Just sometime ago, in Japan TVXQ attended NHK’s year-end award festival Kouhaku Uta Gassen as five members for the first time, however the three members, whose provisional disposition application to terminate exclusive contract against SM Entertainment was accepted by the Korea court as the issue of court injunction, seem to be more passionate in the performance and there was an unseen tense and emotional conflict with the remaining two members that makes the current situation is impossible to predict.

The problem now is whether SM will extend the contract of the 3 members with AVEX after June. The fact that currently TVXQ is at their peak of popularity in Japan is something that can not be ignored under any condition especially in relation to revenue circumstances.

TVXQ is now in a situation of an attempt to reach into final decision amicably to be able to work together in a long-term in Japan.
