[TRANS] Kim Junho Tweets About His Decision To Work With Avex Despite Its Relationship With His Brother


An article regarding the Japanese company I’ll be working with has finally been published. I think there will be lot of people who worry and have unkind things to say about the decision. I had been talking to this agency even before the guys’ problem arose, and I finally made the decision to pursue the venture, seven months since the happening began, after thinking about it and discussing it with my family and those around me.


We’ve settled it so that there is a minimum chance of the situation becoming a problem, so please don’t worry about it too much. I, too, thought long and hard before laying down this decision. Though you may say that it was the wrong decision to make, it has been made and I must take full responsibility of what is to come. I just hope you do not hurt my family. I will just work hard. I’m sorry and I thank you all.

[INFO] 110114 Oricon 2010 Yearly Market Report - Avex & Tohoshinki #2

On the 14th, Oricon compiled and released the 2010 yearly music sales numbers in the [2010 Yearly Market Report]. Based on the annual sales for [Singles], [Albums], [Music DVD], and [Music BD], Arashi, who made their debut in 1999, takes the top spot for the second year running for [Artist Total Sales], with the highest record of ¥17.1 billion (approx. USD$2.1 billion). For the second year running, Sony Music Entertainment, through artists like Ikimonogakari and Nishino Kana, took first place in the category of [Manufacturer Total Sales].

The top 3 in the [Manufacturer Total Sales] category was the same as the 2009 ranking, with the top spot going to Sony Entertainment Music (¥58 billion), followed by Avex Group Holdings (¥46 billion) (approx USD$556 million) in second place, through albums by Tohoshinki and EXILE, and subsequently Universal Music (¥38.6 billion) through the release of Fukuyama Masaharu's best album as well as SNSD and Kara, who raised the KPOP sensation.

[News] Avex talks about TVXQ’s revival and new K-pop contracts


Avex made some announcements on Wednesday regarding its contracts with several Korean artists, particularly TVXQ. That group, which has been on hiatus since April of this year, will be resuming activities with only two of its five members – Yunho and Changmin.
Contract issues led to a fallout between TVXQ’s members and their Korean management agency, SM Entertainment. Since April, the other three members of TVXQ – Junsu, Jejung, and Yuchun – have been signed with a different agency, and they have been performing under the name JYJ for several months. However, SM Entertainment stated that Yunho and Changmin “have not given up on the dream of TVXQ.” As a result, they will revive the TVXQ name in 2011.
Details of their activities are still unknown, but they are expected to restart in January. According to Sankei Sports, one source has said that a new song is already in production for a planned CD release in Japan.
Besides TVXQ, Avex has had contracts with two other SM Entertainment artists, BoA and J-Min, for several years. On Wednesday, they re-announced that they have completed exclusive contracts with two more artists, SUPER JUNIOR and f(x).
It was already revealed several weeks ago that SUPER JUNIOR will be holding three concerts at Yokohama Arena next February to accompany their debut release.

[TRANS] Japan Avex CEO masatomatsuura ‘s tweet about JYJ is creating a commotion

TVXQ’s members, Micky YooCheon, Xiah Junsu, Hero JaeJoong signed a contract with CJes Entertainment and thereby forming JYJ. On the 12th, they mark the start of their first World Tour Showcase at GoRyo University. After the end of the showcase, on the 13th, masatomatsuura posted a tweet at his twitter page saying “I opened my heart and spoke to them but I was betrayed like nothing happened. It’s important to have trust. Especially when you’re in such an industry, trust is a must. I had wished that I can speak of the matters someday.” Adding on he tweeted “Losing is winning. Even it is so now, someday things will change. The strength that allows me to endure such humiliation is perseverance and training. Someday, I will tell these stuck-ups off. Because I will not lose in the end. I’m just talking to myself.” And he added, “If there’s no pain, it’s not interesting.”

For JYJ fans who have seen those messages, they replied harsh messages like “I start to hate Japan.”, “JYJ is so pitiful”, “Bad guy” [this word is not very pleasant in Korean.] But masatomatsuura replied saying “You’ll get your retribution.” “Please be careful of what you say.” With that, a fight of resentment has started.
AVEX has expressed on the 16th sept that because of the law issues that CJes is involved in and the on-going contract issues with SME, AVEX has used these reasons to express that they will stop JYJ’s activities in Japan. With that JYJ expressed on 17th Sep that “we have no intentions to stop our activities in Japan and we had abided with all our contract terms faithfully. But from a few months back onwards, AVEX has started to stress that the contract terms were unreasonable and one-sidedly decided to stop the contract and even issued released news saying that we will be stopping our activities.”

[NEWS] 100930 Avex's split with JYJ - An act of submission?

On September 27th, a news article by Japan’s Asahi News, titled, “DBSK’s comeback potential“, speculated that Avex dropped promotional activities with JYJ because their contract with JYJ hindered Avex’s recruitment of other Korean stars. The article specified that Avex supported JYJ, but this caused a breakdown in relations between Avex and SM Entertainment to the point where the latter signed SNSD with Universal.

In summary, Aera, the author of the article, postulates that Avex split with JYJ as an act of submission to SM Entertainment and other Korean entertainment corporations.

Aera wrote, “It is commonly accepted in Korea that companies spend millions to train and promote artists from their early childhood. Korea’s entertainment business finds it inevitable that contracts must be of a certain length to guarantee profit. JYJ’s split from SM through legal proceedings put a huge scratch on the face of SM and Korea’s business. When Avex salvaged JYJ, it was a direct confrontation with SM.”

“When SNSD and KARA signed under Universal, and 2PM followed up with Sony, Avex had to consider the lack of fresh Korean recruitment. In the end, they opted to drop the immediately, but minimally profitable, JYJ for a chance to sign the new generation’s ‘DBSK’.”

Aera continued, “Just like in Korea, where fame is but an overinflated bubble, when DBSK broke up, their fame took a massive hit. Even in Japan, JYJ’s activities drew negatives comments such as, ‘money hungry dogs’, and other severe criticisms“.

Aera concluded by questioning whether JYJ has a bright future ahead.

[trans] 100927 avex selling of jyj calendar despite activity suspension provokes fans



TVXQ’s Japanese agency, Avex, has been under a bit of heat lately due to the release of a 2011 calendar featuring Jejung, Yuchun, and Junsu. The agency already declared that they would be halting all of JYJ’s activities for now, thus making fans wonder why their products are still being sold if that was the case.

Avex began selling two versions of the JYJ 2011 calendar through music site “Mumo“. Fans who have supported the trio’s promotions are criticizing Avex as having double standards and being hypocritical. TVXQ fancafes and other entertainment forums have been posting criticisms like, “They’re just trying to steal profit.”

In their defense, Avex announced that all these products were already scheduled in advance and would be released regardless of the halt in activities. Yet the clarification is falling on deaf ears. “We are unable to understand why Avex would sell their products when they are not allowing them to promote,” fans said, “Why are they tying down JYJ if they’re going to continue selling their products?”

Avex halted the trio’s Japanese promotions on the 16th, making it impossible for them to continue promoting until their lawsuit with SM Entertainment reaches a conclusion.

[Trans] 100917 Interview With Trio’s Legal Spokesman Lawyer Lim Sang Hyuk

In an interview on the 17th, the trio’s legal spokesman and lawyer Lim Sang Hyuk revealed that, “Avex requested changes in the contract that the members found difficult to agree to in clauses regarding topics such as income distribution.”
Lawyer Lim Sang Hyuk also added, “At first, it was agreed that all activities performed by the three members would be scheduled and discussed by both sides, but Avex began asking for this to be changed so that Avex would have sole control of scheduling; Avex also requested additional changes that the trio felt were logically unacceptable”
Regarding Avex pinpointing the history of the head of C-JeS as the main reason for halting activities, Lawyer Lim explained that, “Mr. Baek, the head of C-JeS, willingly volunteered for his company to be excluded from the contract if his criminal record would become a problem, but Avex ignored such a notice,” and “Later, they deemed that it would be difficult to progress normally with Mr. Baek’s background.”

The TVXQ trio’s official statement said that, “Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan.”
Lawyer Lim stated, “When viewing the chain of events, there were many situations that could only be seen as Avex insisting that things go their way and their way only. If the opposition decides to retaliate, we will release additional information from our side.”
He also added that, “The essence of the current controversy is that an agency offered unfair conditions, contrary to what had been included in the previous contract, to their artistes. When these artistes refused to comply, the agency halted all activities, disregarding the members’ wishes,” and “It is disheartening to see that Avex is using the head of C-JeS, who is not affiliated with any gangs whatsoever, as a scapegoat to distract the media and public from the real problem.”
Lawyer Lim criticized that, “It is immoral to back the TVXQ trio, some of Korea’s most representative Hallyu stars, into a corner just because they cannot fulfill a company’s greed,” and strongly stressed that, “We will work hard to resolve this situation and allow the TVXQ trio to resume their activities in Japan.”

[TRANS] 100917 TVXQ Trio's Official Statement On Avex's Decision To Halt JYJ's Japanese Activities

The TVXQ trio, Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong, released the following official statement regarding Avex's decision to halt the group's activities in Japan.

1) The head of C-JeS has no ties to gangs whatsoever.

Though his previous conviction is true, it was not a verdict made regarding any ties with gangs. Avex was fully aware of this fact before their contract with the TVXQ trio was signed, and as this cannot be classified as a breach of the exclusive contract, it cannot become a reason to halt activities or cancel the contract.

Several months ago, Avex requested that C-JeS be excluded from the contract for such reasons, and the TVXQ trio agreed to such a request and actively participated in the discussions regarding the renewal of their contract with Avex in order to ensure that they would have smooth activities within Japan.

However, Avex put forth conditions that were unfair to the trio unlike their previous contract, and when the trio refused to accept such conditions, Avex stated the gang ties of the head of C-JeS as a reason for canceling the contract, and finally released an official notice stating that no more activities would occur.

While these details were being discussed, the TVXQ trio continued to diligently carry out all scheduled activities to keep their promise with their fans and worked hard to come to an agreement with Avex.

2) The victims of this situation are the TVXQ trio. Avex attempted to coerce the trio to comply to changes in the contract, but when the trio refused to agree to such conditions, Avex announced a halt in their activities with no regard to the trio's opinions.

Since the signing of the contract with the trio till now, Avex has involved the TVXQ trio in various activities aimed at raising the agency's income such as concerts, Xiah Junsu's solo album, participation in another Avex singer's music video, and the recent 'The...' album.

However, Avex has been putting forth unfair conditions to the TVXQ trio, contrary to what had been done in the past, for the past several months by using the past conviction of the head of C-JeS as a pretext, and when these conditions were rejected, Avex began discussions on canceling their contract and announced a halt in activities in order to corner the TVXQ trio.

This can be seen as Avex taking all the money that they can from the TVXQ trio and then proceeding to create a situation that makes it impossible for the trio to sign on with any other agency in Japan, thus blocking the trio's path with regards to Japanese activities. The TVXQ trio had no intentions of stopping their activities in Japan, and the announcement made by Avex reflected only the thoughts of the agency themselves.

3) Avex has made an illogical statement that the contract between Avex and SM Entertainment regarding the five members of TVXQ is still valid though they would suspend Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong's contract.

Regarding this, Micky Yoochun, Xiah Junsu and YoungWoong Jaejoong stated that, "First of all, we are extremely sorry to have to bring our fans such news. Though we actively participated in discussions with Avex in order to come to an agreement, it is regrettable that an announcement to halt our activities in Japan had to be made. Due to this situation, we can't shake the feeling that Avex used the three of us as money making tools rather than treating us like artistes." They also stated, "We feel frustrated that we cannot promise our Japanese fans another meeting in the near future. We need active support and interest from our fans in order to resolve this situation. We hope to resume our activities in Japan and meet our fans again as soon as possible."

Lawyer Lim Sang Hyuk of Sejong, the legal representative of the TVXQ trio, stated, "It is immoral to back the TVXQ trio, some of Korea's most representative Hallyu stars, into a corner just because they cannot fulfill a company's greed. We will work hard to resolve this situation and allow the TVXQ trio to resume their activities in Japan."

The Korean company currently responsible for managing JUNSU/JEJUNG/YUCHUN's activities in Japan is C-jeS CO.LTD. It was reported that the legal representative of this company has been taking advantage of his father's previous status as a gang leader to threaten and coerce the artists under its label. He has already been has been found guilty of, and sentenced to prison on charges of coercion. With regards to the allegations mentioned above, Avex has conducted thorough investigation, and whilst there is no legitimate evidence to prove for certain that the said legal representative has links with the mafia, reports on threats and coercion were found to be true.

At the same time, there is a possibility that JUNSU/JEJUNG/YUCHUN's contract with Avex may be voided as a result of developments in their Korean exclusive contract lawsuit.

Avex holds heavy regard for both the legal and ethical implications of its management guidelines, thus until a clear resolution has been found, we will discontinue our management of the trio's activities.

To fans who have continued to support JUNSU/JEJUNG/YUCHN, we would like to express our apologies for the concern and apprehension this news must have brought you, but we hope that you will understand the decisions we have made.

There will be no changes in our plans for scheduled releases and ongoing activities. Similarly, no changes will be made to the contract we have negotiated with SM Entertainment for Tohoshinki's activities as a 5 member unit. Avex will continue to work towards the comeback of Tohoshinki, just as we have done in the past.

[Trans] 100901 Avex’s Balance Sheet for Q2


Avex Group Holdings reported on the 30th a total budget surplus of 3 billion yen (≈ 35.5 million USD) for the quarter of April-September of this year, compared to a deficit of 476 million yen (≈ 5.6 million USD) in the same quarter of the prior year. It was previously predicted that their surplus would reach 500 million yen (≈ 5.9 million USD). Besides being able to lower the producing cost for their popular artists’ albums last quarter, their profit also came from the great sale result of “ONE PIECE” Theme Song Compilations and DVDs.
Total sales of this quarter worth 58.9 billion yen (≈ 698 million USD), up 1% compared to the same quarter of the prior year; and this number exceeded their expectation by 3.3 billion yen (≈ 39 million USD). For the third quarter of the year, the CD sales of JUNSU/JEJUNG/YUCHUN are expected to accelerate their total sales. Besides, the releases of “ONE PIECE” Character DVD Boxes and Theme Song Compilations are also expected to be another source of their sale acceleration.
Its operating profit is 5.4 billion yen (≈ 64 million USD), which is 3.2 times their profit in the last quarter and exceeded their expectation by 3.9 billion yen (≈ 46 million USD). By purchasing the original recordings of the popular artist Tohoshinki from other recording companies, the company was able to cut down the cost of production for their best album. However, since that was also one reason that accelerate their sales in this quarter, their full-year outlook still remains unchanged.
